Krispy Kreme Donuts is just one of the many companies that may not survive 2009. The company over expanded in the 90's and took on alot of debt and now requires high sales to pay the bills. They have apprx 4000 employees and their stock is down 50%. They have cut costs, but, haven't earned an operating profit in 3 years.

Car seat death leads to charge: Police say mother installed baby's seat improperly

A very sad story....

Spokane County prosecutors charged a Post Falls woman with vehicular homicide Tuesday in the death of her infant daughter, who was severely injured by a car's air bag while riding in a rear-facing car seat in Spokane.
If convicted, it could be the first time in Washington a parent has been held accountable for the death of a child stemming from an improperly installed car seat, prosecutors and police say.
Eileen Jensen's daughter Chloe was riding in a loosely installed, rear-facing car seat in the front passenger seat during the 2006 collision, police said. The car's air bags deployed, which — combined with the impact of the crash — caused the baby's injuries.
She died from her injuries 10 months later, but "her brain stopped developing that day," said Spokane police Officer Teresa Fuller.
In a court document, Jensen, now 24, says she "blacked out" just before the collision.
The charge was filed in Spokane County Superior Court on Tuesday, said Deputy Spokane County Prosecutor Mary Ann Brady. Jensen has not been arrested. She is scheduled for arraignment Feb. 18.
The case had been under review with the prosecutor's office for about a year, authorities said.
"We reviewed police reports, looked at the statute and discussed it with my supervisor," Brady said. "It fits the criteria" for the charge.
On March 22, 2006, Jensen was driving her 2001 Honda Accord on North Freya Street with her three daughters. According to court records, Jensen caused a three-car crash when she smashed into the back of a stopped minivan. Chloe was in the front seat while Jensen's other daughters were in the back, also improperly secured, police said.
When Jensen's car crashed, its passenger-side air bag deployed and caused Chloe's head trauma, authorities said.
Putting a child's head in front of an air bag is like "putting the child's head in front of an explosion," said Alan Korn, director of public policy for Safe Kids USA, a national nonprofit organization focused on preventing childhood injuries.
Child deaths caused by air bags during collisions are extremely rare, Korn said. Since a major educational campaign was launched in the mid-1990s, the incidents have dropped tremendously.


According to Washington law, all children under 13 must sit in a vehicle's rear seat when practical.
After the crash, a witness told police Jensen said she had the baby in the front seat because she only planned to drive a couple of blocks, according to a statement of facts filed in Spokane County Superior Court on Tuesday. Witnesses also told police Jensen was driving erratically right before the crash, according to the court document.
The Honda was "racing out ahead of me and other traffic, but there were cars stopped up the road: I couldn't see why they were stopped, but no one was movin'," Matthew Dixon told police. "I started to slow down, and then saw her crash into the back of that other car."
Jensen, who lives in Post Falls, could not be reached Tuesday for comment.
In the court document, Jensen said she was sleep-deprived, which may have contributed to her blacking out. She also told police she regularly put Chloe in the front seat. Regarding the air bag, "it just wasn't something I was thinking about," she said.
Washington state law says a driver can be charged with vehicular homicide for causing the death of another person by driving under the influence of drugs or alcohol, in a reckless manner, or without regard for the safety of others.
"This is an area of prosecutorial discretion," Korn said. "Criminal negligence has to be present. In most circumstances, I feel the loss of a child is punishment enough. That's a tough one. It does happen, but it is not common."

Broken' Billionaire Merckle Killed Self

Jan. 6 (Bloomberg) -- German billionaire Adolf Merckle committed suicide by throwing himself under a train, “broken” as his business empire crumbled under a growing burden of debt, his family said.
The 74 year-old businessman was hit yesterday evening near his hometown of Blaubeuren, 44 miles southeast of Stuttgart, a police officer said in an interview. His body was found on the tracks at around 7:30 p.m. about 300 yards from his home and a suicide note had also been found.
Merckle, whose holding company owes banks about 5 billion euros ($6.7 billion), owned stakes in HeidelbergCement AG and drug wholesaler Phoenix Pharmahandel AG. He had been seeking emergency financing for more than two months from a group of more than 30 banks led by Commerzbank AG, Deutsche Bank AG, Royal Bank of Scotland Group Plc and Landesbank Baden-Wuerttemberg.
“The dedicated family businessman was broken by his inability to handle the situation and he ended his own life,” his family said in a statement today. “The distress at his companies caused by the financial crisis and the resultant uncertainty of the last few weeks” contributed to his death, the family added.
Merckle, whose estimated $9.2 billion fortune put him 94th on Forbes’ list of the world’s richest people, was hurt by bets on Volkswagen AG, a drop in the value of HeidelbergCement stock and increasing debt. The family’s spiraling debt threatened holdings including its VEM Vermoegensverwaltung GmbH holding company, which owed the bank about 5 billion euros, people with knowledge of the matter said last month.
‘Falling Apart’
“His empire was falling apart,” said Stefan Mueller, managing partner at Proprietary Partners AG in Frankfurt. “This was his last desperate act.”
Merckle’s empire spanned the cement, machinery and drug industries. VEM said today Merckle’s death would have no effect on the restructuring. Merckle was to get more than 400 million euros in bridge loans to rescue VEM, Financial Times Deutschland reported yesterday, citing unidentified bankers.
“News of Adolf Merckle’s death left me deeply shaken,” Baden-Wuerttemberg Prime Minister Guenther Oettinger said. The state “lost a great entrepreneur.”
In November, the state government signaled it would not assist Merckle after he sought a bailout. His companies employ more than 71,000 people, including 46,000 at HeidelbergCement.
Merckle hired insolvency lawyer Eberhard Braun and threatened to initiate bankruptcy proceedings for VEM unless lenders provided him with restructuring capital, two people familiar with the situation said Dec. 10.
HeidelbergCement, Phoenix
The Merckle family may have to sell stakes in HeidelbergCement, Germany’s biggest cement maker, Phoenix Pharmahandel, a drug wholesaler, and Ratiopharm GmbH, a generic drugmaker as part of a deal with banks, people familiar with the matter said on Dec. 15.
HeidelbergCement fell 8.2 percent to 30.60 euros in Frankfurt trading. The Heidelberg-based company declined 70 percent last year, a fall that led the banks to seek additional financial guarantees from the billionaire.
Born in 1934, Merckle fled in 1945 with his family to Blaubeuren, a city with about 12,000 people in southwestern Germany, from the Sudetenland, the historical border region of the Czech Republic long inhabited by ethnic Germans and seized by the Nazis in September 1938.
Merckle’s grandfather founded a company called Drogen und Chemikalien en gros in 1881 and his father expanded the company after taking the helm in 1915. The company was seized during the Nazi era.
Suicide Note
Merckle, a lawyer whose only luxury was climbing in the mountains, took over the family company in 1967 at a time when it had 80 employees and 4 million deutsche marks ($2.5 million) in sales.
There was no suspicion of foul play and police are certain Merckle committed suicide, a police officer in Ulm said. The suicide note didn’t give any reason for his decision, according to the officer. Ulm prosecutors are investigating as a matter of routine, a step done in any suicide case, he said.
Merckle leaves behind his wife Ruth. He had three sons, Ludwig, Philipp, Tobias and a daughter, Jutta.
VEM was caught in a so-called short squeeze after betting Wolfsburg, Germany-based Volkswagen’s stock would fall. Merckle lost at least 500 million euros on the bets on VW stock, people familiar said on Nov. 18. VEM lost “low three-digit million euros” on VW stock, the company said in November.
Financing Talks
Commerzbank expressed its deep sympathy to Merckle’s family, according to spokeswoman Simone Fuchs in Frankfurt today. She declined to comment about potential implications for talks on a financing deal. RBS had no comment, a company spokeswoman in Frankfurt said. Landesbank Baden-Wuerttemberg spokesman Christian Potthoff in Stuttgart also had no comment.
New York based money manager Thierry Magon de La Villehuchet, 65, who may have lost client funds invested with Bernard Madoff, apparently killed himself in his Madison Avenue office, Police Commissioner Raymond Kelly said on Dec 23.
Kirk Stephenson, who helped start Luqman Arnold’s investment company Olivant Ltd., committed suicide, a U.K. coroner’s court judged last month. Stephenson, 47, jumped in front of a train on Sept. 25 at a railway station in Taplow, 28 miles west of London.

School is back. Holidays are over. Back to the old grind. I have enjoyed these past 2 weeks. It was very casual and relaxing at times. Other times...wild and nuts and everybody with cabin fever. I am glad to have some peace and quiet here during the day again. Just me and my little one. He needs the break too!

The Obama girls are starting today too. A new school, new friends, a new life. I wish them luck. No matter who it is, a new school is tough on a kid.

John Travolta's 16-Year-Old Son Dies

Very sad...

John Travolta's 16-year-old son has died, a rep from the Rand Memorial Hospital in The Bahamas confirms to TMZ.com.
Travolta's lawyer, Michael Ossi, tells TMZ that Jett suffered a seizure at his family's vacation home at the Old Bahama Bay Hotel on Grand Bahama Island. Attempts to revive him were unsuccessful and he died on the scene.
It's been reported that Jett suffered from autism, which Travolta has denied -- instead saying Jett is inflicted with Kawasaki Syndrome (the six-year-old son of Backstreet Boy Brian Littrell has the same diagnosis), which can lead to heart disease.
Travolta and wife Kelly Preston are also parents to daughter Ella, 8.

LOS ANGELES – "SpongeBob SquarePants" may be getting squeezed off of Time Warner Cable.
Media giant Viacom Inc. said its Nickelodeon, MTV, Comedy Central and 16 other channels will go dark on Time Warner Cable Inc. at 12:01 a.m. Thursday if a new carriage fee deal is not agreed upon by then.
The impasse over carriage fee hikes would mean "SpongeBob" and other popular shows like Jon Stewart's "The Daily Show" and Stephen Colbert's "The Colbert Report" will be cut off to 13 million subscribers, said spokesman Alex Dudley, a vice president at Time Warner Cable. The nation's second-largest cable operator primarily serves customers in New York state, the Carolinas, Ohio, Southern California and Texas.
Viacom has asked for fee increases of between 22 percent and 36 percent per channel, an amount that could increase customers' cable bills, Dudley said. Viacom spokeswoman Kelly McAndrew said the requested increase was in the very low double-digit percentage range.
"The issue is that they have asked for an exorbitant increase in their carriage fees and their network ratings are sagging," he said. "Basically we're trying to hold the line for our customer."
Viacom said the increases would cost an extra 23 cents a month per subscriber — which works out to $35.9 million more in total. It said that Americans spend a fifth of their TV time watching Viacom shows but its fees make up less than 2.5 percent of the Time Warner cable bill.
"We make this request because Time Warner Cable has so greatly undervalued our channels for so long," it said.
"Ultimately, however, if Nickelodeon, Comedy Central, MTV and the rest of our programming is discontinued — over less than a penny per day — we believe viewers will see this behavior by their cable company as outrageous," it said.
Tense negotiations are continuing at the highest level, Dudley said.
Viacom accused Time Warner Cable of not negotiating.
"It is our sincere hope that they will come to the table and negotiate a deal," said McAndrew. The network operator also intends to tell viewers about the dispute in TV ads in 11 major markets.
Part of the disagreement is that most of the popular shows are rerun on Web sites where Viacom collects advertising revenue that it does not share with Time Warner, Dudley said.
"We don't think that's fair," he said. "They're trying to have their cake and eat it too online, where anybody can get it for free."
Viacom has staked much of its revenue-growth prospects on its ability to extract higher carriage rates out of its cable and satellite affiliates despite an ad slowdown and weak ratings.
In the third quarter, media network revenue, which accounts for about two-thirds of the total, grew 6 percent to $2.1 billion, despite global ad revenue falling 2 percent, largely because of double-digit percentage growth in affiliate fees and the success of its "Rock Band" video game.
Viacom shares rose 69 cents, or 3.7 percent, to close at $19.26 on Tuesday, while Time Warner Cable shares added $1.56, or 7.7 percent, to $21.76.
The channels that would be affected are: Comedy Central, CMT: Pure Country, Logo, Palladia, MTV, MTV 2, MTV Hits, MTV Jams, MTV Tr3s, Nickelodeon, Noggin, Nick 2, Nicktoons, Spike, The N, TV Land, VH1, VH1 Classic, and VH1 Soul.
Pop-up alerts on "The Colbert Report" and "The Daily Show" Web sites Wednesday morning informed fans that Time Warner Cable customers will lose Comedy Central shows soon and urged them to call the cable company and protest the change.
